Agreement to Terms

By accessing our website or booking our photo booth rental services, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Booking and Payment Terms

Deposits and Payment

• A 50% non-refundable deposit is required to secure your event date
• The remaining balance is due 7 days before your event date
• Payment can be made via credit card, check, or bank transfer
• Late payments may result in cancellation of services

Cancellation Policy

• Deposits are non-refundable but may be transferred to a new date within 12 months
• Cancellations made less than 30 days before the event forfeit the full payment
• We reserve the right to cancel services due to weather, equipment failure, or other unforeseen circumstances with a full refund

Service Delivery

Setup and Operation

We will arrive at your venue at the agreed-upon time to set up the photo booth. Setup typically takes 45-60 minutes. The booth will be operational for the duration of your rental period, with a professional attendant present at all times.

Venue Requirements

• Access to a standard electrical outlet within 20 feet of the booth location
• Adequate space as specified in your rental agreement (typically 8x8 to 12x12 feet)
• Indoor setup or covered outdoor area with protection from weather
• Clear access for loading and unloading equipment

Client Responsibilities

As the client, you agree to:

• Provide accurate event information including date, time, venue, and contact details
• Ensure the venue meets our setup requirements
• Notify us of any venue restrictions or special requirements at least 7 days before the event
• Be responsible for the conduct of your guests around the photo booth equipment
• Report any equipment damage or issues immediately to our attendant

Equipment and Property

All photo booth equipment, props, and materials remain the property of Charm City Photo Booths. You are responsible for any damage to equipment caused by negligence or misuse by you or your guests. Repair or replacement costs will be charged to the client.

Photo Rights and Usage

Your Rights

You and your guests retain all rights to photos taken at your event. We provide a private online gallery where you can view, download, and share your photos.

Our Rights

We may request permission to use select photos from your event for marketing purposes including our website, social media, and promotional materials. You may decline this request or request removal of photos at any time by contacting us.

Limitation of Liability

Charm City Photo Booths shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for the rental services.

We are not responsible for delays or failures in service delivery due to circumstances beyond our control, including but not limited to weather, venue restrictions, power outages, or equipment failure.

Force Majeure

We shall not be held liable for any failure to perform our obligations due to unforeseen circumstances or causes beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.
